These Terms of Use, Privacy Policy, Disclaimers, and related policies (collectively, the “Agreement”)
govern your access to and use of the website, programs, memberships, courses, digital products, and
coaching services operated by Jennifer Damchuk (“Company,” “we,” “us,” or “our”) through Kajabi and
associated platforms. By accessing or purchasing from this website, you agree to be legally bound by
this Agreement.

1. Terms of Use

By accessing this website or purchasing any services or digital products, you acknowledge that you
have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must
discontinue use immediately.
All content, materials, methodologies, frameworks, branding, videos, audio recordings, downloads, and
written materials are the intellectual property of Jennifer Damchuk and are protected under Canadian
copyright and intellectual property laws. You may not reproduce, distribute, modify, resell, share login
credentials, or otherwise exploit any content without prior written consent.
The Company reserves the right to modify or discontinue any service, product, or membership at any
time without notice. We are not liable for any modification, suspension, or discontinuation of services.

2. Coaching & 1:1 Services

Coaching services provided by Jennifer Damchuk are educational and informational in nature. They are
not therapy, psychological treatment, medical care, financial advising, or legal services.
Clients are responsible for their own decisions, actions, and results. The Company makes no
guarantees regarding specific outcomes, income levels, health improvements, or personal
transformation.
Payment terms, cancellation policies, and session scheduling requirements are disclosed at time of
purchase. Missed sessions without appropriate notice may be forfeited.
The Company reserves the right to terminate services if a client engages in inappropriate conduct or
violates these Terms.

3. Digital Courses & Memberships

Upon purchase of a digital course or membership, you are granted a limited, non-transferable,
revocable license for personal use only. Access duration (lifetime or limited term) is specified at time of
purchase.
Membership subscriptions are billed on a recurring basis as disclosed at checkout. By enrolling, you
authorize automatic renewal and recurring billing until cancellation.
Cancellation instructions are provided within your Kajabi account. No partial refunds will be issued for
unused portions of subscription periods unless otherwise stated.
The Company may revoke access without refund if intellectual property is misused or community
guidelines are violated.

4. Refund Policy

Refund eligibility, if applicable, is clearly stated on the applicable sales page at time of purchase. If no
refund policy is stated, all sales are final.
Refund requests must be submitted in writing to the Company within the specified time frame. The
Company reserves sole discretion in determining eligibility in accordance with posted policy.

5. Privacy Policy (PIPEDA Compliance)

Jennifer Damchuk complies with the Personal Information Protection and Electronic Documents Act
(PIPEDA). We collect personal information including but not limited to name, email address, billing
information, IP address, and analytics data for the purpose of delivering services, processing
payments, improving user experience, and marketing communications.
Payment processing is handled by third-party providers such as Stripe or PayPal. Email
communications may be managed through Kajabi or integrated email marketing platforms.
Users have the right to request access to, correction of, or withdrawal of consent regarding their
personal information, subject to legal limitations. Requests may be submitted in writing to the
Company.
Reasonable security safeguards are implemented; however, no digital transmission is guaranteed to be
completely secure.

6. Email Marketing & CASL Compliance

In accordance with Canada’s Anti-Spam Legislation (CASL), express consent is obtained prior to
sending marketing communications. You may unsubscribe at any time using the link provided in emails.
Unsubscribe requests are processed promptly.

8. Limitation of Liability

To the fullest extent permitted under applicable Canadian law, Jennifer Damchuk shall not be liable for
any indirect, incidental, special, or consequential damages arising from use of this website, services, or
products. Total liability shall not exceed the amount paid by the user for the applicable product or
service.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of
Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the
exclusive jurisdiction of the courts of Alberta, Canada.
